Welcome to Reelfolio ("we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Reelfolio concerning your access to and use of our video creation platform available at reelfolio.com (the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and posting a notice on our Service. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

1. Eligibility and Account Registration

2. Description of Service

2.1 Service Overview

Reelfolio is a video creation platform that enables users to:

Upload images and videos
Capture website screenshots
Select from animated video templates
Customize template settings (animations, timing, colors)
Generate professional Full HD (1080p) video reels
Download created videos

2.2 Service Availability

We strive to maintain the availability of the Service, but we do not guarantee:

Uninterrupted or error-free operation
Specific uptime percentages or service level agreements
Availability during maintenance, updates, or technical issues
Compatibility with all devices, browsers, or operating systems

The Service relies on third-party infrastructure and services. We are not liable for disruptions caused by third-party service providers.

2.3 Service Modifications

We reserve the right to:

Modify, suspend, or discontinue any aspect of the Service at any time
Change features, templates, or functionality without prior notice
Impose limits on certain features or restrict access to parts of the Service

3. Subscription Plans and Payments

3.1 Service Tiers

Reelfolio offers the following service tiers:

Free Tier:

Limited access to platform features
Template preview and exploration
Upload and manage images
Screenshot capture functionality
Restriction: Cannot create or render video reels

Lifetime Access:

One-time payment for unlimited lifetime access
Unlimited video reel creation and rendering
Access to all current and future templates
Full HD (1080p) video exports
Priority support
All feature updates at no additional cost

3.2 Payment Processing

Payments are processed through our third-party payment provider, Polar.sh. By making a purchase, you agree to:

Polar.sh's terms of service and privacy policy
Provide accurate and complete payment information
Authorize the one-time charge for Lifetime Access
Comply with all applicable payment card industry standards

3.3 Pricing

Lifetime Access pricing is displayed on our pricing page and may be subject to change. Price changes will not affect purchases already made.

All prices are in US Dollars (USD) unless otherwise specified. Applicable taxes may be added at checkout based on your location.

3.4 Refund Policy

Refunds are handled on a case-by-case basis. To request a refund, please contact our support team with:

Your order details and purchase date
Reason for requesting a refund
Description of any issues experienced

We will review refund requests individually and respond within 14 business days. Approved refunds will be processed through the original payment method within 10 business days.

Factors we consider when evaluating refund requests:

Time elapsed since purchase
Service usage and feature utilization
Technical issues or service failures
Circumstances beyond the user's control

We reserve the right to deny refund requests in cases of:

Abuse of the refund policy
Excessive usage before requesting a refund
Violation of these Terms

3.5 Billing and Customer Portal

You can manage your purchase history, view invoices, and access billing information through the customer portal provided by Polar.sh.

4. User Content and Intellectual Property

4.1 Your Content

"Your Content" means any images, videos, screenshots, URLs, or other materials you upload, create, or provide through the Service.

You represent and warrant that:

You own or have the necessary rights, licenses, and permissions to use and grant us rights to Your Content
Your Content does not infringe any intellectual property rights, privacy rights, or other rights of third parties
Your Content complies with all applicable laws and regulations
Your Content does not contain illegal, harmful, or offensive material

4.2 License Grant to Reelfolio

By uploading or creating Your Content on the Service, you grant Reelfolio a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

Use, reproduce, and store Your Content to provide the Service
Process and modify Your Content to render videos and apply templates
Display and distribute Your Content within the Service features
Create derivative works (rendered videos) from Your Content
Enable technical operations such as storage, backup, and content delivery
Develop and improve our templates, algorithms, and Service features

This license exists solely to enable us to operate and improve the Service. We will not use Your Content for advertising or commercial purposes without your explicit permission.

4.3 Ownership

You retain all ownership rights to Your Content. The license granted to us does not transfer ownership.

Rendered videos created using our templates are provided to you for download and use. You own the output videos, subject to our intellectual property rights in the templates and technology.

4.4 Public URLs and Content Accessibility

IMPORTANT: All uploaded images and generated videos are stored with publicly accessible URLs.

By uploading content or creating videos on the Service, you acknowledge and agree that:

Public Storage: All images you upload and videos you generate are stored on third-party cloud storage services (Cloudinary, Supabase) with public URLs
No Access Control: Anyone with the URL can access, view, and download your uploaded images and rendered videos
Permanent Accessibility: URLs remain accessible even after you delete content from your account, subject to our storage provider's policies
Search Engine Indexing: Your content may be indexed by search engines if the URL is discovered or shared publicly
No Privacy Guarantee: You should not upload sensitive, confidential, or private information that you do not want to be publicly accessible

You are solely responsible for:

Ensuring you have the right to make your content publicly accessible
Not uploading content that contains private, sensitive, or confidential information
Understanding that sharing URLs will grant others access to your content
Accepting the risk that URLs may be discovered or shared without your knowledge

We recommend:

Only uploading content you are comfortable being publicly accessible
Not including personal information, private documents, or sensitive data in your uploads
Using watermarks or other protective measures on content you wish to protect
Treating all uploads as public from the moment they are uploaded

We are not responsible for unauthorized access to or distribution of Your Content resulting from the public nature of storage URLs.

4.5 Our Intellectual Property

The Service, including all templates, designs, code, graphics, logos, trademarks, and technology, is owned by Reelfolio and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal or commercial purposes, subject to these Terms.

You may not:

Copy, modify, or create derivative works of our templates or Service code
Reverse engineer, decompile, or disassemble any aspect of the Service
Remove or alter any copyright, trademark, or proprietary notices
Use our intellectual property to create a competing service
Scrape, data mine, or extract data from the Service using automated tools

4.6 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use, implement, and commercialize such feedback without any obligation or compensation to you.

5. Acceptable Use Policy

5.1 Prohibited Content

You may not upload, create, or share content that:

Violates any law, regulation, or third-party rights
Contains malware, viruses, or malicious code
Infringes intellectual property rights (copyright, trademark, patent)
Contains child sexual abuse material (CSAM) or exploits minors
Promotes violence, terrorism, or harm to individuals or groups
Constitutes hate speech, harassment, or discrimination
Contains private or sensitive personal information without consent
Is pornographic, obscene, or sexually explicit
Promotes illegal activities or substances
Contains false, misleading, or deceptive information
Violates any person's privacy or publicity rights

5.2 Prohibited Activities

You may not:

Use the Service for any illegal purpose or in violation of any laws
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service, servers, or networks
Use automated tools (bots, scrapers) to access the Service without permission
Abuse rate limits or attempt to circumvent usage restrictions
Impersonate any person or entity, or misrepresent your affiliation
Collect or harvest information about other users without consent
Sell, rent, or commercialize access to the Service without authorization
Upload excessively large files or abuse storage resources
Engage in any activity that could harm, disable, or impair the Service

5.3 Screenshot Compliance

When using our screenshot capture feature, you agree to:

Only capture screenshots of websites you have permission to access
Comply with the terms of service of websites you screenshot
Respect robots.txt files and web scraping policies
Not use screenshots for illegal surveillance or privacy violations

5.4 Enforcement

We reserve the right to:

Remove or disable access to any content that violates these Terms
Suspend or terminate accounts engaged in prohibited activities
Report illegal activity to law enforcement authorities
Preserve evidence of violations for legal proceedings
Take any other action we deem necessary to protect the Service and users

6. Usage Limits and Restrictions

6.1 File Upload Limits

To ensure fair usage and system stability, the following limits apply:

Individual file size: Maximum 5 MB for images, 20 MB for videos
Total session upload: Maximum 400 MB per upload session
Accepted formats: Images (.jpg, .jpeg, .png, .webp) and Videos (.mp4, .webm, .mov)

6.2 Screenshot Capture Limits

Rate limit: Maximum 20 screenshot requests per hour per IP address
Supported viewports: Desktop (1920x1080) and Mobile (375x667)
Output format: JPEG images

6.3 Rendering Timeouts

Maximum rendering time: 5 minutes per video
Videos exceeding the timeout will fail and may require adjustment of settings or image count

6.4 Free Tier Restrictions

Users on the Free Tier cannot:

Create or render video reels
Download generated videos
Access premium templates or features (if applicable)

Upgrade to Lifetime Access to unlock full functionality.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using the Service, you acknowledge and agree to:

The collection, use, and sharing of your information as described in our Privacy Policy
The use of cookies and similar technologies
The transfer of your data to third-party service providers
International data transfers for users outside the United States

9. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT OR TITLE
ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE
ERROR-FREE OR UNINTERRUPTED OPERATION

9.2 No Guarantee of Results

We do not guarantee:

Specific quality or characteristics of rendered videos
Compatibility of output videos with all platforms or devices
Availability or performance of third-party services
Permanent storage or backup of your uploaded content
Recovery of deleted content or accounts

9.3 Technical Limitations

You acknowledge that:

Video rendering may fail due to file size, format, or technical issues
Uploaded content may be lost due to technical failures or data loss
Third-party service outages may affect Service availability
Browser compatibility and internet connectivity may impact user experience

9.4 User Responsibility

You are solely responsible for:

Maintaining backups of Your Content
Ensuring compatibility of uploaded files
Verifying rendered video quality before use
Compliance with applicable laws when using the Service

10. Limitation of Liability

10.1 Liability Cap

TO THE FULLEST EXTENT PERMITTED BY LAW, REELFOLIO'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

10.2 Excluded Damages

IN NO EVENT SHALL REELFOLIO BE LIABLE FOR:

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
COST OF SUBSTITUTE GOODS OR SERVICES
LOSS OF GOODWILL OR REPUTATION
PERSONAL INJURY OR PROPERTY DAMAGE (EXCEPT AS REQUIRED BY LAW)

THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Copyright and DMCA

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

Deleting your account through the Service settings
Contacting our support team to request account deletion

Upon termination:

Your personal information and uploaded content will be deleted within 90 days
Lifetime Access purchases are non-refundable (subject to our refund policy)
Certain information may be retained for legal or business purposes

13.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice or liability, for:

Violation of these Terms
Fraudulent, illegal, or abusive activity
Extended inactivity

13.3 Effect of Termination

Upon termination by either party:

All licenses granted to you under these Terms will immediately cease
You must cease all use of the Service
We may delete or disable your account and content
Sections of these Terms that by their nature should survive will continue to apply (including warranty disclaimers, liability limitations, indemnification, and dispute resolution)

14. Dispute Resolution and Governing Law

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

15.6 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and Reelfolio as a result of these Terms or use of the Service.

We may provide notices to you via email, postal mail, or by posting on the Service. You consent to receive communications electronically.
